Everything governing your relationship with the platform in one place: terms of use, privacy, escrow and transfer, commission and fees, and intellectual property. Written to be understood first, and precise second.
Brandagy is an Egyptian joint-stock company, part of the SWVT information systems group. We are an intermediary platform: we do not own the listed domains and are not a party to the sale; we run verification, listing presentation, and secure escrow. These documents are not legal advice.
Document 01
Terms of Use
The general framework governing your use of the platform, whether you are a buyer, a seller, or a visitor.

Nature of the service
Brandagy operates a platform connecting owners of names with the founders looking for them. We do not own the listed domains and are not a party to the sale contract; we run ownership verification, listing presentation, escrow, and the optional services attached to a listing.

Eligibility
You must be eighteen or over, have the legal capacity to contract, and not be subject to any prohibition on entering commercial transactions.

Your account and its security
You are responsible for the confidentiality of your credentials and for all activity on your account. Creating multiple accounts to manipulate offers or evade a ban is prohibited. Identity verification is required before listing or receiving funds, and may be required of buyers in high-value transactions.

Seller obligations
On publishing a listing, the seller warrants that:
they legally own the asset, or hold express authorisation to sell it.
the asset is free from litigation, liens, and transfer obligations to any other party.
every published description is accurate and everything in it is actually deliverable.
the asset is not offered at a lower price elsewhere while an accepted offer stands here.

Buyer obligations
Offers must reflect a genuine intent to buy, and payment must reach escrow within the stated period after acceptance. Verifying that the name suits your business is your own responsibility.

Prohibited conduct
Price manipulation and sham offers, impersonation, completing a deal outside escrow after making contact through the platform, scraping, and listing names that infringe third-party marks are all prohibited.

Suspension and termination
We may suspend an account with written reasons. Transactions already in escrow are either completed or refunded under the refund policy.

Limitation of liability
The platform is provided "as is". We do not warrant that a listing will sell, its market value, or its fitness for a particular purpose. Our liability is in all cases capped at the commission collected on the transaction in dispute.

Governing law
These Terms are governed by the laws of the Arab Republic of Egypt, and the Cairo Economic Courts have jurisdiction over any dispute arising from them, after the amicable settlement stage set out in the dispute resolution policy has been exhausted.

Privacy Policy
What data we collect, why, who we share it with, and how you control it.

Data we collect
We collect three categories only:
Account data: name, email, phone number, country, and a profile photo if you add one.
Usage data: search history, saved listings, offers made, and the brand pages you visited.
Transaction data: what is needed to complete transfer through escrow, including billing details and sellers' bank account numbers.

How we use it
Operating the marketplace, improving result ranking for your market, notifying you about offers and orders, and meeting legal and accounting obligations. Explicitly: we do not use your data to train marketing systems for third parties.

What we never do
We do not sell personal data, do not share your search history with sellers, do not disclose a buyer's identity before their offer is accepted, and never expose your saved list unless you switch on public visibility yourself.

Sharing with third parties
We share only what is necessary with the escrow provider, the registrar, service providers you explicitly choose, and the authorities under a binding legal request.

Cookies
Strictly necessary cookies, plus optional aggregated analytics you can decline with no loss of function, expiring after thirteen months.

Retention periods
Account data while the account is active, transaction records for seven years, and usage data for twenty-four months before it is anonymised.

Your rights
You have the right of access, correction, deletion — absent an active transaction — export, and objection. We respond within thirty days.

Cross-border transfers
Processing may occur outside Egypt, and only with providers offering contractual guarantees no weaker than this policy.

Escrow & Transfer
How funds are held, when they are released, and what happens if delivery fails.

The escrow principle
No funds reach the seller before the domain reaches the buyer.

Stages of a deal
Five stages, matching the order status page exactly:
Payment into escrow.
Seller confirms, within two business days.
Domain transfer, within three to seven days.
Receipt confirmed and the delivery files unlock.
Funds released, within two business days.

Automatic confirmation
If the buyer neither confirms receipt nor opens a dispute within seven days of the registrar confirming transfer, receipt is deemed confirmed. The purpose is to protect the seller from unjustified stalling.

Failed delivery
If the asset stays locked for more than sixty days or is subject to an ownership dispute, the full amount is refunded with no deduction and the listing is flagged.

Fees
There is no fee for escrow itself; its cost is carried by the commission.
06
Currency
Settlement is in USD because escrow and transfer operate in it; local-currency figures are indicative only.

Commission & Fees
What you pay and when, at published rates that never change retroactively.

Listing is free
No listing fee, no subscription, and no renewal charge.

Commission
Commission is due only on a completed sale, deducted from escrow before the seller's share, and calculated on the final agreed value, not the listed price. Published tiers:
Up to $10,000: 10%
$10,001 – $50,000: 8%
Above $50,000: 6%

Optional services
Priced separately and shown before ordering. Services delivered by Brandagy are added to the deal value; services provided by the seller carry no additional commission.

Featured listing
A published flat fee that changes neither the commission rate nor the likelihood of a sale.

Taxes
Prices exclude taxes, each party handles its own tax obligations, and an itemised invoice is issued for every transaction.

Price changes
Thirty days notice, never retroactive to existing listings or to offers accepted before the effective date.

Refund & Cancellation
A clear timeline: before transfer begins, after it begins, and after it completes.

Before transfer begins
Cancellation and a full refund, with no fee.

After transfer begins
No unilateral cancellation. The deal can be reversed by mutual agreement, minus the actual costs incurred at the registrar.

After transfer completes
The sale is final, because the asset is no longer something we can recover.

Broken listings
If a listing turns out to be undeliverable or materially different from its description, the full amount is refunded even mid-transfer, and the seller bears the cost.

Services already delivered
Optional services are non-refundable to the extent they have actually been delivered.
06
Refund timing
Refunds are issued within five business days to the original payment method.

Intellectual Property & Trademarks

What transfers to the buyer
Full domain ownership, the economic rights to the wordmark and visual identity, and unlimited rights to the brand story. The seller signs an assignment declaration included in the delivery files.

What does not transfer
The designer's prior work, and third-party licensed fonts or images unless the listing says otherwise.

Trademarks
Our check is a first pass for apparent conflicts — not a comprehensive search and not a registration. Conflict searching and registration remain the buyer's responsibility.

Infringement complaints
A complaint must be documented with the registration number, class, and evidence; it is reviewed within five business days; the listing is suspended where infringement is apparent; and the seller has a right of reply.

Fair use of platform names
Naming Brandagy is fine; using its logo in a way that implies a partnership is not.
06
User content
You keep ownership of what you publish; we receive a non-exclusive display licence for the listing period plus six months for record purposes.

Listing & Content Rules
The minimum that makes a listing a ready-made brand rather than a parked domain.

Listing minimums
Four elements before anything goes live; anything short of them stays a draft:
A verified, owned domain.
A vector wordmark.
A brand story of at least forty words.
A current handle availability report.

Rejected names
Marks infringing in the same class, anything abusive, inciting, or discriminatory, impersonation of a government body, and names implying a professional licence that does not exist.

Description accuracy
No inflated valuations presented as fact, no false attribution to a prior venture, and no implying a trademark registration that does not exist.

Review
Review happens within two business days, with reasons, and we never edit a listing on the seller's behalf without consent.

Price changes
The price can change at any time, never retroactively to an accepted offer; a reduction notifies everyone who saved the brand and enabled that alert.
06
Simultaneous listing
Permitted, with an obligation to withdraw immediately on accepting an offer here, and to notify us if the asset sells elsewhere.
Document 08
Dispute Resolution
A defined path with deadlines, from opening a dispute to deciding it.

Opening a dispute
Available while funds are in escrow and for thirty days after release; opening one halts automatic release.

Amicable settlement
Five business days for the parties to agree in-platform; anything agreed is logged and binding.

Intervention and decision
The escrow team requests documents and decides within ten business days: complete the release, refund in full, or a partial settlement at a stated ratio.

Decision criteria
The listing as published at the time of purchase, the in-platform message log, the registrar's transfer record, and the documents submitted. Off-platform agreements that cannot be evidenced are not considered.
05
Restricted accounts
Three disputes decided against the same party within twelve months trigger account restriction and additional verification.
06
After the decision
The decision is final within the platform, without prejudice to recourse before the competent courts.

Accessibility & Acceptable Use
What we commit to for every user, and what we expect in return.

Our commitment
WCAG 2.2 level AA on every page: contrast, full keyboard navigation, 44px touch targets, and reduced-motion respected. Reviewed every six months.

Reporting a barrier
We respond within five business days with a temporary alternative and a fix date. We never ask you to prove a disability to receive help.

Automated use
No scraping, no automated account or offer creation, and no rate-limit evasion; structured access is available on request for research or integration.

Platform security
No penetration testing without written permission; good-faith vulnerability reporters are welcomed and not pursued.
05
Language and direction
Arabic is the primary language and English is fully supported; where the two texts differ, the Arabic prevails.
